Privacy and Cookie Policy
This privacy policy (this “Privacy Policy”) describes the privacy practices that Opine Market, Inc. (“Opine,” “us,” or “we”, or “our,” as the context dictates) follows when collecting and using personal information and data collected by Opine when you interact with our website at https://tryopine.com (the “Website”), our web-based application at https://app.tryopine.com (the “Application,” and together with the Website, the “Sites”), our products and services, and any other sites or services that link to this Privacy Policy.
This Privacy Policy describes what information we gather from you and others who visit or use the Sites, how we collect, receive, use, store, share, transfer, and process your Personal Data (as defined below), and what we do to protect it. This Privacy Policy also describes your choices and rights with respect to your Personal Data, including your rights of access and correction of your Personal Data. For the purposes of this Privacy Policy, “Personal Data” means any information that can be used to identify an identified or identifiable individual, including, but not limited to: (a) first and last name; (b) mailing address; (c) email address; (d) phone (or mobile) number; and (e) IP addresses. If you do not agree with this Privacy Policy, you should not use our Sites, product and services, or any other sites or services that link to this Privacy Policy. Your use of the Sites and submission of Personal Data to us constitutes acceptance and understanding of this Privacy Policy.
Opine customers may collect and manage Personal Data when using our product and services, or what we may refer to as the Services. The “Services” is defined in the Opine Customer Terms of Service and means all of our Sites, platform, tools, applications, data, software, and services comprising the Application that streamlines an organization’s proof of concept evaluation process of third party software tools and transactions that you have subscribed to under an Order Form or that we otherwise make available to you, and are developed, operated, and maintained by us, accessible via https://app.tryopine.com or another designated URL, and any ancillary products and services, including website hosting, that we provide to you.
We reserve the right to change or update this Privacy Policy from time to time, which modifications shall become effective upon your receipt of notice thereof. We encourage you to check here periodically to review the current Privacy Policy, which is effective as of the revision date listed above. Defined terms not otherwise defined in this Privacy Policy will have the meaning as set forth in the Opine Customer Terms of Service.
1. What Information We Collect and Process
a. Information You Provide to Opine
When you interact with us via our Sites or any sites or services that link to this Privacy Policy or use the Services, we may automatically collect Personal Data and other information from you, as further described below.
When You Visit Our Sites
We may automatically collect Personal Data from you when you submit web forms or interact with our websites, for example by subscribing to an Opine blog, signing up for a webinar, subscribing to one of our services or requesting customer support. You are free to explore some of our websites without providing any Personal Data about yourself.
Event Information
We collect Personal Data when you register for an Opine event. We use this information to communicate with you and in some cases facilitate your registration. Additionally, we may share your registration data with service providers.
Account and User Information
We collect Personal Data when you sign-up for an Opine account, create or modify user information, set preferences, or provide any other related information to access or utilize our Services.
Payment Information
We may collect payment and billing information when you register for paid products or services. If and to the extent applicable based on your preferred method of payment, you may also provide payment information, such as a credit card number or bank account numbers, when purchasing products or services to Opine’s designated third party payment processor.
Customer Testimonials
We may post customer testimonials and comments on our websites, which may contain Personal Data. We obtain each customer’s consent via email or through other agreements between customers and Opine prior to posting the customer’s name and testimonial.
b. Information We Process on Behalf of Customers When They Use the Services
Our product, or the Services, allows our customers to create and share marketing, sales and customer service content. When customers use our product, they may collect Personal Data such as first and last name, email address, physical address, phone number, or other information about you. We call the information that our customers submit or collect via the product ‘Customer Data’ under our Customer Terms of Service.
We do not control the content of our customers’ webpages or the types of Personal Data that our customers may choose to collect or manage using the Services. We store our customers’ information on our service providers’ servers but process it as a processor under our customers’ instructions and in accordance with our Customer Terms of Service, which prohibit us from using the information except as necessary to provide and improve the Services and as required by law.
Our customers control and are responsible for correcting, deleting or updating the information they process using the Services and for complying with any regulations or laws that require providing notice, disclosure, and/or obtaining consent prior to transferring the Personal Data to Opine for processing purposes.
c. Information We Collect and Process When You Use the Services
Usage Data
We collect usage data when you or your users in your Opine account interact with the Services. Usage data includes metrics and information regarding your use and interaction with the Services such as what product features you use the most, and how often certain features are triggered in your account.
We engage third party providers to collect usage data.
Third Party Integrations
You may connect third party integrations to your Opine account, which may ask for certain permissions to access data or send information to your Opine account. It is your responsibility to review any third party integrations you authorize. We may collect information about what types of integrations you use in your Opine account.
Any permission(s) granted by you, grants these third parties access to your data, which may include (but is not limited to) granting third party applications access to view, store, and modify your Opine account data. We are not responsible for the practices of third party integrations, so please carefully review the permissions you grant to third party applications.
Additional Limits on Use of Your Google User Data
Our use and transfer to any other app of information received from Google APIs will adhere to the Google API Services User Data Policy, including the Limited Use requirements.
Google Analytics
The Sites and/or Services may use Google Analytics and similar web analytics services. Google Analytics is used to track unregistered users on the Sites and/or the Services, to record multiple visits by unregistered users to the Sites and/or the Services, and to record all the pages that unregistered users visit at the Sites and/or Services. If and when an unregistered user registers with the Sites and/or the Services, all of his or her previous visits and activity on the Sites and/or the Services will be associated with his or her registered user profile. Google Analytics tracks registered users’ visits to the Sites and/or the Services whenever they return.
The Sites and/or the Services use Google Analytics to track, collect, or upload any Personal Data, or other data that can reasonably be linked to such information by Google in accordance with the terms as found at Customer Terms of Service.
The Sites and/or the Services may use all features of Google Analytics for Display Advertisers including obtaining specific visitor cookie data, such as the source, medium, and keyword used to visit the Sites and/or the Services. Google Analytics does not store any visitor specific data, and the Sites and/or the Services may use specific data regarding users in any way related to Google Analytics, Google Adwords, and Remarketing.
The Sites and/or the Services may use remarketing with Google Adwords and analytics to display content specific advertisements to users who previously visited the Sites and/or the Services when those users go to other websites that have Google Display Network implemented.
The Sites and/or the Services and other third-party vendors, including google, use first-party cookies (such as the Google Analytics cookie) and third-party cookies (such as the DoubleClick cookie) together to inform, optimize, and serve ads based on users’ past visits to the Sites and/or the Services.
The Sites and/or the Services may facilitate the merging of Personal Data with non-personally identifiable information that is collected through any Google advertising product or feature. BY USING THE SITES AND/OR THE SERVICES, YOU SPECIFICALLY AND AFFIRMATIVELY PROVIDE US WITH YOUR CONSENT TO THAT MERGER OF PERSONAL DATA AND NON-PERSONALLY IDENTIFIABLE INFORMATION.
You can opt-out of Google Analytics for Display Advertising and customize Google Display Network ads using Google’s Ad settings.
You can also opt-out of Google Analytics for Display Advertising, to prevent your data from being used by Google Analytics, by going to the Google Analytics opt-out page.

d. Information We Collect From Other Sources
Opine Partners
We may receive information about you or other users of your Opine account from our network of partners. We may receive this data from our deal and lead registration process through our partners.
Third Parties
We may receive information from third party service providers, from related companies, and from our business and solution partners.
Personal Data from Different Sources
We may combine the Personal Data we collect from you with Personal Data we receive from other sources, such as third party providers of business information and publicly available sources (like social media platforms). This may include physical mail addresses, job titles, email addresses, phone numbers, IP addresses, and social media profiles. This helps us to update and improve our records, identify new customers, create more personalized advertising, suggest products and services that may interest you, deliver personalized communications and promote events. The collection of your Personal Data by these other third party providers is governed by the provider’s privacy policy.
Log Files
Like most websites and technology services delivered over the Internet, we automatically collect and store information about your computer hardware and software when you visit our websites, use our product and services, or visit other sites or services that link to this Privacy Policy. This information can include your IP address, browser type, domain names, internet service provider (ISP), and the files viewed on our websites (e.g., HTML pages, graphics, etc.), the files viewed on our, or our customer’s websites (if those websites are hosted on Opine, e.g. HTML pages or, graphics, etc.), your operating system, access times and referring website addresses.
When you use the Services, we collect and store the categories of information listed above in logs when you log into your account and access tools in the Application, subject to your implementation settings.
Buttons, tools, and content from other companies
Our websites may include features and widgets (such as the share and/or “like” button or interactive mini-programs) that run on our websites. These features may collect your IP address, which page you are visiting on our sites, and may set a cookie to enable the feature to function properly. These features and widgets are either hosted by a third party or hosted directly on our websites. This Privacy Policy does not apply to these features. Your interactions with these features are governed by the privacy policy and other policies of the companies providing them.
2. How We Use Personal Data
a. To Communicate with You About the Product and Services
We use the account information you provide to Opine when signing up for the Services to send you transactional emails or in-app notification about billing, account management, and other administrative matters. We may also send you updates regarding our Customer Terms of Service or other legal agreements, and may also communicate with you about security incidents via email or in-app notification.
We use your information to provide customer support, such as resolving technical issues you encounter and analyzing product outages or bugs.
b. To Provide the Services
We use your account information and Customer Data to provide the product and services to you. For example, we use the email address you provide when signing up for the product to create your user account, and we and/or our designated third party payment processors may use your payment information to process payments for paid use of the Services. We also use this information to authenticate you when you log in and to provide customer support.
c. To Improve and Develop Our Product and Services
We collect usage data about how you or your users interact with our product and services. We use this data to develop and improve our products and services. For example, we use usage data to assess trends and usage across the product to help us determine what new features or integrations our users may be interested in.
We use Customer Data for machine learning that supports certain products and development of features and functionality with the Services and similar products and services. You may opt-out of having your Customer Data used for machine learning by emailing support@tryopine.com.
We may publish data about how our product and services are being used across our customer base for purposes of: (a) creating benchmarking, statistical, research and marketing analyses, surveys, reports, and studies; and (b) improving the Services. When we share statistical information externally in this way, the data will be aggregated and in blinded formats that do not identify, reference, or imply an association with any individual users or customers. For example, we may publish blog posts on trends or insights into how users are interacting with our product.
d. To Secure and Protect our Product and Opine Users
We use your account information to investigate and help prevent security incidents. We may also use this information to meet legal requirements. We use your information to verify user accounts, new product sign-ups, and to detect and prevent product abuse. This includes enforcing our Customer Terms of Service.
We use log files to provide general statistics regarding use of the websites by you, including how you use our websites, what country you are logging in from (for analytics, export control and regulatory purposes) and to help improve the navigation experience. Your IP addresses are also collected and logged for security and debugging purposes, for example to track access patterns, investigate security events and incidents. For these purposes we do link this automatically-collected data to other personal data provided by you such as name, email address, address, and phone number.
e. To Market and Promote the Services
We use the information you provide to Opine to market and promote the products, services, and other offerings. For example, we use the information, like your email or physical address, to send information or Opine content to you which we think may be of interest to you by post, email, or other means and send you marketing communications relating to our business.
You may opt out of receiving this promotional content by following the instructions contained in each communication that we send to you or by contacting us at support@tryopine.com. If you unsubscribe from our marketing lists, we will continue to contact you regarding administrative matters, and to respond to your requests.
We may also reach out to you via telephone to ask about other Opine products or services you may be interested in. If you have a call scheduled with an Opine representative, we may record and transcribe the call. You will be notified prior to the call that the call is being recorded, and you will be offered an opportunity to opt-out of having the call recorded.
Where required by law, we will only send marketing communications with your consent. Otherwise, we will market and advertise our products and services on the basis of our legitimate business interests.
We receive information from third party service providers and other sources such as third party providers of business information and publicly available sources. We may receive and use this information from these service providers and other sources in combination with other information we collect through other means described in this Privacy Policy for the purposes of providing you with updates and improved Services, like personalized communications, event promotion, and tailoring the websites or product to improve user experience.
f. Other Purposes if We Obtain Your Consent
We share your data with third parties when you give us consent to do so.
g. Retention of Personal Data
Following termination or deactivation of your account for the Services, we may retain Personal Data and other information related to your account, in order to comply with applicable law, prevent fraud, resolve disputes, troubleshoot problems, assist with any investigation, enforce our rights under our agreements with you, for backup, audit or regulatory purposes, and for other actions permitted by law. Otherwise, we will only retain your personal data for as long as reasonably necessary to fulfill the purposes we originally collected it for (the “Retention Period”). To determine the appropriate Retention Period for Personal Data, we consider the amount, nature and sensitivity of the Personal Data, the potential risk of harm from unauthorized use or disclosure of your Personal Data, the purposes for which we process your Personal Data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting, or other requirements.
3. How We Share Personal Data
a. Service Providers
We may share Personal Data with our third party service providers to support our Sites, products, and services. For example, we use service providers for data hosting, application development, marketing, sales support and customer support. We may need to share your information with service providers to provide information about products or services to you. Examples may include removing repetitive information from prospect lists, analyzing data or performing statistical analysis on your use of the Services or interactions on our websites, providing marketing assistance, processing credit card payments, supplementing the information you provide us in order to provide you with better service, developing and improving the product and services, and providing customer service or support. These service providers are prohibited from using your Personal Data except for these purposes, and they are required to maintain the confidentiality of your information. In all cases where we share your information in this way, we explicitly require the third party service providers to acknowledge and adhere to our privacy and data protection policies and standards.
b. Public Forums
Our Sites may offer publicly accessible message boards, blogs, community forums, and integration into third party messaging services. Please keep in mind that if you directly disclose any information through our public message boards, blogs, forums (including profile information associated with the account you use to post the information), or integrated messaging services, it may be read, collected and used by any member of the public who accesses these websites. Your posts and certain profile information may remain even after you terminate your account. We urge you to consider the sensitivity of any information you may disclose in this way. We will correct or delete any information you have posted on the websites if you so request, as described in Section 6 “Your Privacy Rights and Choices” below. In some cases, we may not be able to remove your information, in which case we will let you know if we are unable to and why.
dc. Compelled Disclosure
We reserve the right to use or disclose your Personal Data if required by law or if we reasonably believe that use or disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or comply with a law, court order, or legal process. If you use the Services, Customer Data is considered Confidential Information and you should review the Confidentiality terms in the Customer Terms of Service for more information.
4. Cookies and Similar Technologies
a. Cookies
To enable our Sites to recognize your browser or device and to provide and improve our Services, we use cookies and other identifiers. We may collect Personal Data and other information through the Sites by way of cookies or other tracking technologies. Cookies and other tracking technologies are script files that facilitate the collection of non-personally identifying information, such as the number of visitors to the Sites, how each visitor arrived at the Sites and the visitor’s use and behavior patterns on the site to ensure a better customer experience.
We use certain first-party cookies, which do not require your consent, that commonly are referred to as “strictly necessary cookies.” These cookies ensure our digital services work correctly and meet audience needs and interests. We use the following strictly necessary cookies:
Session cookies: the use of these cookies is strictly limited to the transmission of session identification data (random numbers generated by the server), which are necessary to allow the safe and efficient exploration of the Sites and/or the Services. They are not permanently stored on your device and disappear when the browser is closed or after a period of inactivity. In particular, the use of session cookies is aimed at the security and improvement of the Services offered;

Profiling cookies: these cookies are used to track your navigation on the web and to create profiles on your tastes, habits, choices, etc. With these cookies, advertising messages can be transmitted to your device in line with the preferences already expressed by you when browsing online. In accordance with the regulations applicable to the Sites and/or the Services, you may “opt out” of the use of these cookies and the performance of the processing operations connected to them. The deactivation of such third-party cookies does not compromise the use of the Sites and/or the Services; and
Multimedia content player: these cookies store technical data to play back video or audio content for the duration of a session.

The Sites use various analytics tools that use cookies to process information including standard internet log information and details of the visitor’s behavioral patterns upon visiting our site. These tools are used to provide you with a better experience, and to facilitate the use of certain functions. Upon request, we will provide you with additional information about these tools including how you can opt-out from information processing by these tools.

b. Pixels (aka web beacons/web bugs/java script).
We may use pixels to automatically record certain technical information about your interactions with us when you visit the Sites or otherwise engage with us, to help deliver Cookies on our Sites, or count users who have visited the Sites. We may also include web beacons in our promotional e-mail messages or newsletters to determine whether you open or act on them for statistical purposes. Pixels are tiny graphics (about the size of a period at the end of a sentence) with unique identifiers used to track certain online actions, movements and related information of Sites users. Unlike cookies, which are stored on a user’s computer hard drive, pixels are embedded invisibly on web pages or in HTML-based emails. The data we receive through pixels allows us to effectively promote the Sites to various populations of users, and to optimize external ads about the Sites that appear on third-party websites.
5. Your Privacy Rights and Choices
a. Personal Data Requests
You have the following data protection rights:
Access, Correction or Deletion. You can request access, correction, updates or deletion of your Personal Data.
Objection. You can object to our processing of your Personal Data, ask us to restrict processing of your Personal Data or request portability of your Personal Data.
Withdraw Consent. If we have collected and processed your Personal Data with your consent, then you can withdraw your consent at any time. Withdrawing your consent will not affect the lawfulness of any processing we conducted prior to your withdrawal, nor will it affect processing of your Personal Data conducted in reliance on lawful processing grounds other than consent.
Complaint. You have the right to complain to a data protection authority about our collection and use of your Personal Data.
We do not sell Personal Data.

Please note that to protect personal information, we may verify your identity by a method appropriate to the type of request you are making. Depending on where you reside, you may be entitled to empower an “authorized agent” to submit requests on your behalf. We will require authorized agents to confirm their identity and authority, in accordance with applicable laws. You are entitled to exercise the rights described above free from discrimination.
We will respond to your request to change, correct, or delete your data within a reasonable timeframe and notify you of the action we have taken. In some instances, your rights may be limited, such as where fulfilling your request would impair the rights of others, our ability to provide a service you have requested, or our ability to comply with our legal obligations and enforce our legal rights.
If you are a customer, prospect, or otherwise interact with an Opine customer that uses our Services and would like to access, correct, amend or delete your data controlled by the customer, please contact the relevant customer directly. Opine acts as a processor for our customers and will work with our customers to fulfill these requests when applicable.
b. Anti-Spam Policy
Our Customer Terms of Service applies to us and to our customers and, among other things, prohibits use of the Services to send unsolicited commercial email in violation of applicable laws, and requires the inclusion in every email sent using the Services of an “opt-out” mechanism and other required information. We require all of our customers to agree to adhere to the Customer Terms of Service at all times, and any violations of the Customer Terms of Service by a customer can result in immediate suspension or termination of the Services.
c. To Unsubscribe From Our Communications
You may unsubscribe from our marketing communications through one of the following methods:
by clicking on the “unsubscribe” link located on the bottom of our emails;
updating your communication preferences; or
contacting us at support@tryopine.com.
Customers cannot opt out of receiving transactional emails related to their account with us or the Services.
6. California Privacy Rights (for California residents only)
The “California Consumer Privacy Act of 2018” became effective January 1, 2020, and was amended by the “California Privacy Rights Act of 2020” effective January 1, 2023 (together, “CA Privacy Laws”). The CA Privacy Laws grant California consumers new rights related to their Personal Data. The CA Privacy Laws afford California consumers new rights to transparency about data collection including rights to control access and use of their Personal Data, including, but not limited to, the right to correct personal information and opt out of data sharing. To the extent applicable to us, we comply with CA Privacy Laws. We do not sell your Personal Data. We do share some of your information with our trusted service providers, to market our services and operate the Sites. We do not allow these third parties to use your information for their own purposes. Personal Information we collect is retained by us for the Retention Period following your last use of the Services. If you wish to opt out of data sharing, correct Personal Data, or exercise any other rights you have under the CA Privacy Laws, please contact us at the email specified below in this Privacy Policy.
Under California’s “Shine the Light” law, California residents who provide Personal Data in obtaining products or services for personal, family, or household use are entitled to request and obtain from us once a calendar year information about the customer information we shared, if any, with other businesses for their own direct marketing uses. If applicable, this information would include the categories of customer information and the names and addresses of those businesses with which we shared that information for the immediately prior calendar year (e.g., requests made in 2024 will receive information regarding 2023 sharing activities). To obtain this information, please contact us at the email specified below in this Privacy Policy with “Shine the Light Request” on the subject line and in the body of your message. We will provide the requested information to you at your email address in response. Please be aware that not all information sharing is covered by the “Shine the Light” requirements and only information on covered sharing will be included in our response.
Pursuant to California Civil Code Section 1789.3, California users are entitled to the following consumer rights notice: California residents may reach the Compliant Assistance Unit of the Division of Consumer Services for the California Department of Consumer Affairs by mail at 1625 North Market Blvd., Sacramento, California 95834, or by telephone at (916) 445-1254 or (800) 952-5210.
7. COPPA (Children Online Privacy Protection Act)
When it comes to the collection of Personal Data from children under the age of thirteen (13) years old, the Children’s Online Privacy Protection Act (the “COPPA Rule”) puts parents in control. The Federal Trade Commission, United States’ consumer protection agency, enforces the COPPA Rule, which spells out what operators of websites and online services must do to protect children’s privacy and safety online. We do not specifically market to children under the age of thirteen (13) years old.
To protect children’s Personal Information, we do not knowingly collect any Personal Data from persons under the age of eighteen (18) that can be used to specifically identify them, and we do not permit persons under the age of eighteen (18) to use the Sites or the Services. If we become aware that a child under the age of thirteen (13) has provided us with Personal Data, we will immediately take steps to delete the Personal Data submitted and terminate the account.
